BACKGROUND INFORMATION

This seminar will be focusing on various themes relating to the regulation of Company Service Providers (‘CSPs’), with a number of speakers exploring different topics, in particular the regulatory requirements and engagement with the MFSA in different phases of a CSP’s authorisation.

  • An overview of the CSP Rulebook including new governance requirements
  • Regulatory reporting and why does it matter
  • Supervisory engagement including inspections – What to expect and what are your obligations
  • Overview of common themes and findings identified through supervisory engagement

Why is the session of relevance to our members?

The session is particularly relevant for those members/non-members who are interested in learning more about CSPs’ obligations and the expectations of the MFSA in this regard.

SPEAKERS' PROFILEs

Karen Cutajar has been involved in the authorisation processes of persons seeking authorisations to carry out company services, professional trustees and other fiduciary service providers such as mandatories and administrators of private foundations since 2014. She is currently the Senior Manager within the TCSP Authorisation Team.  She holds a Diploma in Financial Services Operations and Compliance obtained from Enterprise LSE, a division of the London School of Economics and the MITC.  She also obtained the Foundation Certificate in Trusts Law and Management of the Institute of Financial Services Practitioners.
Nadia Doublet graduated at the Institute of Tourism Studies, Malta with a Higher National Diploma in Hospitality Management. She later moved into the area of corporate and trustee work where she worked for various years and gained extensive experience working with trust and company service providers. She joined the MFSA in 2020, as an Analyst forming part of the Trustees and Company Service Providers Team, within Conduct Supervision. She is currently primarily focused on offsite supervision, including reviews of regulatory submissions by Trustees & CSPs, although she has also worked in onsite supervision as well as having been involved in due diligence and authorisation processes. She also obtained the Foundation Certificate in Trusts Law and Management by the Institute of Financial Services Practitioners.
Sheryl Agius graduated with a Doctor of Laws from the University of Malta in 2016 and also holds a Master of Laws with specialisation in corporate and commercial law from the University of London. Dr Agius joined the MFSA in 2016 as an Analyst forming part of the team responsible for the supervision of company service providers, trustees and other fiduciaries, within Conduct Supervision. She is currently a Senior Analyst of the team, particularly focused on onsite supervision and providing general support to the team.  Dr Agius has also delivered training sessions for trustee and CSP practitioners. She also obtained the Foundation Certificate in Trusts Law and Management by the Institute of Financial Services Practitioners
Enya Tanti forms part of the offsite team responsible for the supervision of company service providers, trustees and other fiduciaries. In 2018 she graduated with a Masters in Advocacy. She was admitted to the bar in 2019. One year later she also graduated with a Masters in European Business Law from the University of Malta. After working for two years in a CSP and following the submission of her thesis, which focused on the indirect tax treatment of Initial Coin Offerings, Enya joined the MFSA in 2020. In 2021 Enya obtained the Foundation Certificate in Trusts Law and Management by the Institute of Financial Services Practitioners.
Angela  Thorns joined the MFSA in 2020 as part of the team responsible for the reform to the Company Service Providers regulatory framework and the implementation of this reform.  She graduated as Doctor of Laws from the University of Malta in 2002 and was admitted to the Bar in 2003. She advanced her academic studies by reading for a Master of Arts in Financial Services, graduating in 2004. Angela has held senior roles with law firms and corporate service providers advising clients, both locally and internationally, on a wide range of corporate, commercial and maritime matters.  She has also held the role of director and company secretary with regulated entities. Angela was awarded a Diploma in Taxation by the Malta Institute of Taxation and the Foundation Certificate in Trusts Law and Management by the Institute of Financial Services Practitioners.
