    BACKGROUND INFORMATION

    MiFID II/MiFIR established a harmonised EU/EEA passporting framework that enables authorised investment firms to provide services and carry out investment activities across borders, either on a services basis or through branches, under a streamlined home/host supervisory model. For Malta-based firms, notifications are submitted via the MFSA as the home competent authority, facilitating access to other EU/EEA markets without duplicative licensing processes. The regime continues to develop through ESMA guidance and supervisory practice, including areas such as reverse solicitation, cross border marketing conduct, the use of tied agents, the post Brexit third country landscape, and ongoing supervisory expectations. This session unpacks the legal framework and provides insight into its practical execution, including operational steps, governance controls, and documentation standards that advisors, and compliance professionals can apply when supporting clients wishing to expand cross border or reviewing passported operations. Attendees will gain a structured understanding of the rules and current regulatory expectations, with an emphasis on implementation in day to day practice.

Kyra also has a keen interest in AML/CFT laws and has developed substantial experience in mergers and acquisitions over the course of her professional career. Before joining Deloitte Malta in 2024, Kyra worked at a top-tier law firm for eight years, where she dedicated most of her time assisting clients within the regulated space with obtaining authorisations to perform regulated services in Malta, and supporting them on an ongoing basis in meeting their legal and regulatory obligations. Since joining Deloitte, Kyra has taken on a leading role in a number of high-profile client engagements, many of which involve the provision of on-going technical support to regulated entities.

      Mirko Rapa is a tax partner at PwC Malta and provides tax advice to a wide and varied portfolio of clients. Over the last 24 years has provided tax advice to companies operating in a number of sectors and individuals taking up residence in Malta. Mirko has also been involved in a number of national initiatives when it comes to PMLFT matters and is also the Risk Management partner of PwC Malta.
      Giles Schembri is a Partner at KPMG in Malta and apart from being an audit and assurance leader, he currently spearheads audit quality initiatives, leads root-cause-analysis projects, sits on the Firm’s Executive Management Committee, is the country leader for Quality and Risk Management and is also the Firm’s MLRO and Compliance Principal. Outside the Firm, Giles is the deputy chair on the Ethics Committee at the Malta Institute of Accountants and also sits on the Gaming Committee of the same institute.

      Dr Jeanette Calleja Borg is a practitioner in the area of tax compliance with over 18 years experience. She read for a Bachelor of Commerce, a Bachelor of Accountancy (Hons.), a Masters in Financial Services from the University of Malta and subsequently a Ph.D in Taxation from the School of Law, within the Centre for Commercial Legal Studies at Queen Mary, University of London. Her area of research was Cross Border Group Loss Relief in the EU. Dr. Calleja Borg has also been a guest researcher at the Institute for Austrian and International Tax Law in Vienna. Dr. Jeanette Calleja Borg is a member of the Malta Institute of Taxation Council a Member the Malta Institute for Accountants and sits on the direct tax committees of both institutes.

        licenced to offer CSP and trustee services.
        As a dedicated compliance specialist, Elizabeth focuses on navigating the intricate landscape
        of anti-money laundering and counter-financing of terrorism regulations as well as specialising
        in regulatory compliance for CSPs and trustees. Her extensive experience extends to serving
        as MLRO for CSPs, Trustees, and Fiduciaries, as well as retirement pension schemes
        companies. Beyond her role, Elizabeth provides AML training and guidance contributing to
        the development and enhancement of compliance standards within the industry.
        Dr Borg graduated as a lawyer in 2010, subsequently reading Master’s Degree in International
        Criminal Law, with the United Nations Interregional Crime Institute in Turin. Before joining
        Dixcart, Elizabeth served as an employment law prosecutor and also worked at the Court of

          The rapid growth of crypto-assets has brought increased regulatory scrutiny, placing Crypto-Asset Service Providers (CASPs) at the forefront of Anti-Money Laundering (AML) compliance efforts. At the same time, other obliged entities and service providers interacting with CASPs—such as financial institutions, payment providers, and corporate service providers—are increasingly exposed to crypto-related risks.
          A key development in this space is the implementation of the Travel Rule, which introduces new requirements around the collection and sharing of originator and beneficiary information in crypto transactions. This creates both operational and compliance challenges for CASPs and their counterparties.
          As regulatory expectations continue to evolve, organisations must ensure they are equipped to identify, assess, and respond to financial crime risks effectively.
