Tunisia Regime

Council Implementing Regulation (EU) 2022/113 of 27 January 2022 implementing Regulation (EU) No 101/2011 concerning restrictive measures directed against certain persons, entities and bodies in view of the situation in Tunisia and Council Decision (CFSP) 2022/118 of 27 January 2022 amending Decision 2011/72/CFSP concerning restrictive measures directed against certain persons and entities in view of the situation in Tunisia.

On 28 January 2022 the Council of the European Union decided that on the basis of a review, the information in Annex I to that Regulation regarding the statements of reasons should be amended for three persons, and the information relating to the application of the rights of defence and right to effective judicial protection under Tunisian law should be amended for seven persons. Accordingly Annex I to Regulation (EU) No 101/2011 has been amended. Please kindly refer to the above links for further information.


ISIL (Da'esh) and Al-Qaida Regime

Commission Implementing Regulation (EU) 2022/117 of 27 January 2022 amending for the 328th time Council Regulation (EC) No 881/2002 imposing certain specific restrictive measures against certain persons and entities associated with the ISIL (Da'esh) and Al-Qaida organisations.

On 24 January 2022, the Sanctions Committee of the United Nations Security Council decided to remove one entry from the list of persons, groups and entities to whom the freezing of funds and economic resources should apply. Accordingly, Annex I to Regulation (EC) No 881/2002 has been amended.

Resolution 1970 (2011) concerning Libya 

On 28 January 2022, the Security Council Committee established pursuant to resolution 1970 (2011) concerning Libya enacted the amendments, specified with strikethrough and underline, in the link above on its Sanctions List of individuals and entities. For further information please kindly consult the above link.

Please be reminded that all EU/UN sanctions are directly applicable under Maltese law (without the need of any further legislation or notification) under the National Interest (Enabling Powers) Act, cap 365 of the Laws of Malta as linked here.

Should any of your clients be a person or entity who is listed under UN/EU or national sanctions or who is directly or indirectly owned or controlled by a listed person or entity, the freezing measures mentioned under article 17 of the Act apply.

The Sanctions Monitoring Board is to be informed immediately of the actions that have been taken in relation to the assets of such listed persons.
