Objectives of this session

The Department of Industrial and Employment Relations (DIER) will be answering to many of the frequently asked questions being currently asked in light of the recent COVID19 disruptions on employment.
Employment Law, the obligations of the employer to the employee and conversely have not changed, if the employment contract has not been altered.
So what is causing all this havoc? The circumstances for employment have changed drastically so this gives rise to a number of questions.
  • What happens in this instance when an employee refuses to turn up for work even though there is work for him to do and the teleworking option is not available? Can the company put the employee on unpaid leave?
Where there is work to be performed, the employee is to report to work as usual. The fact that the employer is receiving the COVID wage supplement from the Government does not mean that there are any changes to the employment conditions. If any employee wishes to absent himself from work then s/he is to apply for vacation leave; such vacation leave is always to be taken in agreement with the employer as per normal procedure.
  • What happens should one’s vacation leave entitlement be exhausted?
Should one’s vacation leave entitlement become exhausted the employee is either to report to work or else, if an agreement for unpaid leave is reached between the employer and the employee, the employer must seek approval from DIER for unpaid leave. If such approval is granted and the employee continues to be employed on an unpaid basis then s/he may contact the Social Security Department so that he may check whether s/he is eligible for any social measures.
  • When the employee is on unpaid leave benefitting from the COVID wage supplement. Is the vacation leave entitlement affected?
During periods of unpaid leave vacation leave, the vacation leave entitlement does not continue to accrue.
